These Terms of Service ("Terms") govern your use of the website located at davyjonesdiversfl.com (the "Site") and any services provided by Davy Jones Divers ("we," "our," or "us"). By accessing the Site or requesting services, you agree to be bound by these Terms.
1. About Our Services
We provide commercial underwater maintenance services in South Florida, including yacht hull cleaning, zinc anode inspection and replacement, propeller and running gear service, underwater video inspections, and dock dredging. Services are performed by trained divers at your slip or dock.
2. Quote Requests and Scheduling
A quote request submitted through the Site is an inquiry, not a binding agreement. After receiving your request, we will follow up to confirm scope, pricing, and scheduling. A service booking is formed only once we provide a written confirmation and you accept the terms of that confirmation.
All scheduled services are subject to weather, tide, visibility, and safety conditions. We reserve the right to reschedule or cancel a service visit when conditions make safe diving impractical. You will be notified as soon as possible in those cases.
3. Your Responsibilities
When engaging our services, you agree to:
- Provide accurate information about your vessel, its location, and access to the slip or dock.
- Ensure that the vessel is accessible and that nothing on or around the vessel poses a hazard to our divers during service.
- Secure any marina access, permits, or permissions required for us to reach the vessel.
- Notify us promptly of any changes to scheduled appointments, access arrangements, or vessel condition.
4. Payment
Payment terms, amounts, and methods will be specified in your written service confirmation. Unless otherwise agreed in writing, payment is due upon completion of service. Late payments may be subject to collection costs as permitted by Florida law.
5. Cancellations
Either party may cancel a scheduled service. To avoid a cancellation fee, please give us at least 24 hours' notice. Cancellations made with less notice, or missed appointments, may be billed at our standard rate. Our cancellation policy will be confirmed in your written service confirmation.
6. Limitation of Liability
Our divers take reasonable care to avoid damage to vessels during service. If we cause damage through our negligence, we will work with you in good faith to resolve it and will involve our commercial general liability insurance carrier as appropriate.
To the fullest extent permitted by law, our total liability for any claim arising out of the Site or the services will not exceed the amount you paid us for the specific service that gave rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages, or for lost profits, lost data, or loss of use.
7. Disclaimer of Warranties
The Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Service-specific warranties, if any, will be set out in your written service confirmation.

10. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses, including reasonable attorneys' fees, arising out of your misuse of the Site, your breach of these Terms, or your violation of any law or the rights of a third party.
